In the sentence, the judge applied the legal figure “unjustified justification” in which the person cannot be convicted. In the case of Adelio, it was confirmed that he was not subject to recovery, that is, he could not be punished for mental illness.
“I turned the detention into a temporary detention order and determined that the defendant was detained at the Federal High Security Prison in Campo Grande / MS,” the judge wrote in the sentence.
“Hospitalization should continue for an indefinite period of time and until a medical termination is established, the end of danger,” said Savino.
The attack took place on September 6 last year, when Bolsonaro, still a presidential candidate, participated in the campaign in Juiz de Fora.
Adelio Bispo was arrested the same day and, according to the military police of Minas Gerais, confessed that he was the author of the injection.
According to the rules, when the process ends and resources are no longer available, prior hospitalization will be final if the punishment is retained in the higher courts.
According to Judge Bruno Savino, Adelio was “proved unprovable,” and therefore “the accused must be released from punishment.”
According to the magistrate, Adelio Bispo cannot enter the general prison system, since it will "bring him a specific risk of death."

In the ruling, Judge Bruno Savino also stated that official experts and defense assistants and prosecutors emphasized in the lawsuit Adelio Bispo “high danger”.
Savino noted that Adelio, for example, had already threatened to kill Bolsonaro and former President Michel Temer when he left prison.
“Thus, even if there is no real risk of escape, if it occurs, the defendant’s desire to draw attention to the life of the current President of the Republic, as well as the former President, is sufficiently substantiated in the case file.” wrote the judge.

When he comments on this case, usually in an interview, President Bolsonaro often says that if it were up to him, Adelio would “mock in prison.”
In testimony directed to the judge, Bolsonaro was asked if he had noticed Adelio Bispo’s approach before the blow. He said no. When asked, if he managed to protect himself, he also replied that he did not.
"According to the doctors, my survival was a miracle, a lot of suffering in three operations, and to this day I suffer from the consequences of this attempted execution," he added.
